PART A – MEAD PHYSIO GROUP GENERAL TERMS & CONDITIONS

(Applies to Physiotherapy, Exercise Physiology 1:1, Massage Therapy, and all clinical services)

1. Introduction
These General Terms and Conditions govern all clinical and allied health services provided by Mead Physio Group ABN 86 404 742 917 (“MPG”). By booking an appointment (online or otherwise), attending a session, or using our services, you agree to be bound by these Terms. These Terms work in conjunction with the Exercise Right & Rehab Studio (“Studio”) Terms (Part B).

2. Bookings & Deposits
- Appointments may be booked online via our website, by phone, or in person.
- Online bookings for clinical appointments may require a $50 deposit at the time of booking. This deposit is fully credited toward the cost of the service upon attendance.
- You must arrive on time. Late arrivals may result in a shortened session charged at the full fee.
- MPG reserves the right to decline, modify, or reschedule any booking for clinical, safety, or operational reasons.

3. Cancellation & Non-Attendance Policy (Clinic Services)
- Four business hours’ notice is required to cancel or reschedule without penalty.
- For online bookings: Cancellations with less than 4 business hours’ notice or non-attendance will result in forfeiture of the $50 deposit.
- For other bookings, a non-attendance fee of $50 may apply.
- Repeated late cancellations or no-shows may result in mandatory prepayment or suspension of online booking privileges.
- NDIS-funded services: NDIS participants are subject to the NDIS short notice cancellation rules (currently two clear business days for most therapy supports) as set out in the current NDIS Pricing Arrangements and Price Limits. In the event of any inconsistency between this policy and the NDIS rules, the NDIS Service Agreement and current NDIS Pricing Arrangements and Price Limits prevail. See also clause 11 (NDIS Services) in Part A and clause 13 in Part B.

4. Fees & Payment
- All fees are payable at the time of service unless otherwise agreed in writing.
- You remain personally liable for any gap fees or amounts not covered by Medicare, private health insurance, NDIS, Workers’ Compensation, or other third-party funders.

5. Debtor Management & Outstanding Accounts
Outstanding accounts will be managed in accordance with our Debtor Management Policy. This may include reminder notices, suspension of future services and access, and referral to a mercantile agent or debt collection agency. You agree to pay all reasonable debt recovery costs where permitted by law. Payment plans may be offered at our discretion in cases of genuine financial hardship.

6. Consent to Treatment
- You provide informed consent to assessment, treatment, and related services by our qualified practitioners.
- You may withdraw consent at any time, after which treatment will cease.
- You warrant that all health, medical, injury, and medication information provided is accurate and complete.
- All treatments carry inherent risks. These risks will be discussed with you as appropriate.

7. Privacy
We collect, use, store, and disclose your personal and health information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy. You consent to the collection, use and disclosure of your personal and health information for the purposes of treatment, administration, billing, funding claims, and coordination of your care.

8. Respectful Conduct
We are committed to a safe, inclusive, and professional environment. Abusive, threatening, discriminatory, violent, or inappropriate behaviour will not be tolerated and may result in immediate suspension or termination of services.

9. Liability (Clinic Services)
To the maximum extent permitted by law, MPG and its staff are not liable for any injury, loss, or damage arising from failure to follow instructions, undisclosed medical conditions, or inherent risks of treatment. Nothing in these Terms excludes your rights under the Australian Consumer Law.

10. Minors
Clients under 18 years require consent from a parent or legal guardian. A parent/guardian may be required to attend sessions where clinically appropriate.

11. NDIS Services
NDIS participants are also bound by our separate NDIS Service Agreement. In the event of inconsistency, the NDIS Service Agreement and current NDIS Pricing Arrangements and Price Limits prevail.

12. Changes to Terms & Governing Law
We may update these Terms from time to time. Continued use of our services constitutes acceptance of the updated Terms. These Terms are governed by the laws of Western Australia.

13. Complaints
We welcome feedback and take all complaints seriously. If you have any complaint about our services, please contact us in writing at kalamunda@meadphysiogroup.com.au (or in person). We will acknowledge your complaint promptly and aim to resolve it fairly and efficiently. You may also contact the Health and Disability Complaints Office (HaDSCO) in Western Australia or the Australian Health Practitioner Regulation Agency (AHPRA) where appropriate. A copy of our Complaints Management Policy is available on request.

PART B – EXERCISE RIGHT & REHAB STUDIO TERMS & CONDITIONS

EXERCISE RIGHT & REHAB STUDIO SUMMARY OF KEY TERMS

Services: Access to the Exercise Right & Rehab Studio, including independent gym/Studio use, weekly class entitlements in accordance with the selected membership tier, specialised rehabilitation and exercise programs, delivered through the Studio. Membership inclusions and class entitlements vary between membership tiers and may be amended from time to time. A mandatory pre-participation assessment is required for most classes and programs (except Mat Pilates where participation may be permitted following completion of an approved Health & Participation Waiver).
Agreement Type: Ongoing weekly direct debit membership with a minimum commitment period of 12 weeks from commencement.
Cooling-off Period: You have a 7-day cooling-off period from the date you sign this agreement (or the date you first access the Studio, if later). You may cancel in writing during this period. Reasonable administration fees and fees for services already used may be deducted.

Fees and Charges: Refer to the current pricing schedule on our website:
- Weekly membership fees are charged by direct debit.
- Fees cover Studio access and weekly class entitlements and are payable regardless of attendance.
- Additional fees may apply for class packs, specialised programs, fob replacement, etc.
- The total minimum cost for the initial 12-week term depends on the selected membership tier.

Exclusions, Limitations and Restrictions:
- Mandatory pre-participation clinical assessment for most classes/programs.
- Unused weekly classes do not roll over.
- Class packs expire at the end of their validity period.
- Cancellations during the minimum term may require payment of remaining fees (subject to medical hardship discretion).
- Suspensions are limited to 12 weeks per calendar year and extend the minimum term.

This summary is provided in accordance with the Fair Trading (Fitness Industry Code of Practice) Regulations 2020 (WA). The full terms are set out below.

MEMBERSHIP & PARTICIPATION TERMS & CONDITIONS

1. Introduction

These Membership & Participation Terms & Conditions govern all memberships, class packs, specialised programs, Studio access, and participation in services provided by Exercise Right & Rehab Studio (“the Studio”), operated by MPG ABN 86 404 742 917. Clinical services, including Physiotherapy consultations, Exercise Physiology consultations, initial assessments, reassessments and review appointments, are governed by Part A (Mead Physio Group General Terms & Conditions). These Terms supplement Part A (Mead Physio Group General Terms & Conditions), which apply to all services provided by MPG, including Exercise Right & Rehab Studio. Part B contains additional terms specific to Exercise Right & Rehab Studio memberships, class packs, classes, specialised programs, Studio access, and participation. To the extent of any inconsistency relating specifically to Studio memberships, class packs, classes, specialised programs or Studio participation, Part B prevails. By signing up for a membership, purchasing a class pack, enrolling in a specialised program, booking, or attending a class or session, or accessing the Studio premises, you acknowledge and agree to be bound by these Terms.

2. Mandatory Pre-Participation Assessment
All clients participating in Studio classes, specialised programs, or independent gym/Studio access must complete an initial assessment with a qualified Physiotherapist or Exercise Physiologist prior to participation.
An exception applies to Mat Pilates classes, where participation may be permitted without a prior assessment provided the participant completes the Studio's Health & Participation Waiver and any other requirements determined by the Studio.
This assessment is required to ensure safe participation and to enable appropriate, individualised exercise prescription based on your health status, goals, functional capacity, and any relevant medical considerations.
The Studio reserves the right to deny or restrict access to classes, programs or facilities until the assessment or approved waiver process has been completed.

3. Mat Pilates – Waiver Exception
As the only exception to the mandatory assessment rule, Mat Pilates classes may be attended without a prior clinical assessment provided you complete and sign a Health & Participation Waiver confirming that:
- You have disclosed all relevant injuries, medical conditions, symptoms, and limitations that may affect your participation.
- You are not currently undergoing treatment that would affect exercise participation.
- You understand the general nature of the class and accept responsibility for your participation.
The Studio reserves the right to require a full Physiotherapy or Exercise Physiology assessment at any time if risks are identified. Participants must immediately inform staff of any changes to their health, injury status, or symptoms.

4. Membership Options
Membership inclusions vary according to the selected membership tier. Details of current membership inclusions are available in the current pricing schedule on the website.

5. Membership Rules
- Memberships are ongoing weekly direct debit agreements until cancelled in accordance with these Terms.
- Membership fees are charged for access to the Studio and the weekly class entitlements included in the selected membership tier and are not dependent upon actual attendance or utilisation of those classes.
- Membership fees remain payable regardless of attendance. Missed classes do not entitle the member to refunds, credits, reduced fees or make-up sessions unless otherwise determined by the Studio.
- Unused weekly class entitlements do not roll over to subsequent weeks.
- Minimum membership commitment period: 12 weeks from the membership commencement date.
- Cooling-off period: 7 days from sign-up. Cancellation requests during the cooling-off period must be submitted in writing. The Studio may deduct reasonable administration fees and fees for services already used.
- Following completion of the minimum term, memberships may be cancelled with 7 days' written notice.
-Where cancellation occurs during the minimum term, the Studio reserves the right to require payment of the remaining minimum term fees. The Studio may, at its discretion, waive or reduce these fees in cases involving medical hardship, injury or other exceptional circumstances supported by appropriate documentation, or where otherwise required by applicable law.
- This membership agreement complies with the Fair Trading (Fitness Industry Code of Practice) Regulations 2020 (WA). You may request a copy of the Code at any time. Information regarding staff qualifications is available on request. A copy of the Studio Rules (clause 10) has been provided or made available to you prior to signing.

6. Booking Eligibility & Payment Requirement
Clients must hold a valid membership, class pack, pass or approved payment arrangement to book and attend classes.
Exception: Active membership holders may book classes in advance in accordance with the class entitlements and booking privileges associated with their selected membership tier, provided their membership is current and in good standing.
Non-membership clients (including class pack holders) must have a valid prepaid session, class pack balance, or active payment method at the time of booking.
The Studio reserves the right to cancel or remove any booking that does not have a valid entitlement, membership, class pack, pass, or payment method attached.

7. Bookings & Cancellation Policy (Classes)
- All classes and sessions must be booked in advance and are subject to availability on a first-come, first-served basis. The Studio cannot guarantee ongoing availability in any class, session, instructor, or time slot.
- A minimum of four business hours’ notice is required to cancel a class without penalty.
- Cancellations made with less than 4 business hours’ notice, or non-attendance (no-show), will result in the class being forfeited and deducted from the client’s class pack, specialised program allocation or weekly membership entitlement as though attended.
- This forfeiture policy applies equally to membership clients and class pack holders.
- Unused class entitlements do not roll over, and forfeited classes are not refundable, transferable, re-creditable or exchangeable except where required by law or otherwise determined by the Studio at its discretion.

8. Class Packs & Specialised Programs
General Fitness Class Packs are non-refundable, non-transferable, and valid from the date of purchase as follows:
- 6 Class Pack – 3 months
- 10 Class Pack – 6 months
- 20 Class Pack – 12 months
Unused classes expire at the end of the applicable validity period and cannot be redeemed for cash, refunded or transferred to another person.The Studio may, at its discretion, grant an extension in exceptional circumstances, including injury, illness, hospitalisation, or other situations supported by appropriate documentation.
Specialised Programs, including but not limited to: ONERO®, GLA:D® Hip & Knee, GLA:D® Back, Neuro Fitness (PD Fight Club), and Strength for Life™, are practitioner-led rehabilitation and exercise programs that require an initial assessment prior to participation unless otherwise approved by the Studio.
Specialised Program services may be purchased as class packs or bundled service packages.
Specialised Programs may be subject to separate fees, expiry periods, eligibility requirements, and participation conditions, which will be advised at the time of enrolment.

9. Suspensions
Memberships may be suspended for a minimum period of 1 week and a maximum cumulative period of 12 weeks per calendar year.
Suspension requests should be submitted in writing at least 7 days prior to the requested suspension start date.
Medical suspensions may require supporting documentation.
Approved suspension periods will extend any applicable minimum membership commitment period by the duration of the suspension.
Memberships cannot ordinarily be cancelled while suspended. Cancellation requests will take effect upon the recommencement of the membership, except where otherwise required by law or approved by the Studio due to medical or exceptional circumstances supported by appropriate documentation.
The Studio may, at its discretion, approve shorter notice periods, retrospective suspension requests, or suspension periods exceeding the annual limit in cases of illness, injury, accident, medical treatment, travel, or other exceptional circumstances.
All suspension requests are subject to review and approval by the Studio.

10. Studio Rules & Safety
You agree to:
- Follow all staff instructions and use equipment safely and as prescribed.
- Wear suitable exercise clothing and enclosed soft-soled footwear.
- Maintain good hygiene, bring a towel, and wipe down all equipment after use using the wipes provided by the Studio.
- Immediately disclose any injuries, symptoms, health changes, or medical conditions.
- Behave respectfully toward staff and other members.
- Clients are responsible for their personal belongings. To the extent permitted by law, MPG and the Studio are not responsible for the loss, theft or damage of personal property brought onto the premises.
- Members are responsible for exercising within their own capabilities and must cease activity and seek assistance if they experience pain, dizziness, illness, or other concerning symptoms.

Prohibited:
Food (except as permitted), alcohol, smoking, illicit drugs, abusive or discriminatory behaviour, and sharing of access fobs. Breaches may result in suspension or termination of access.
Equipment, facilities, classes, and services may occasionally be unavailable due to maintenance, repairs, staff availability, or operational requirements. The Studio will make reasonable efforts to minimise disruption but does not guarantee uninterrupted availability.
Clients may be held responsible for damage caused by deliberate misuse, reckless conduct or negligent use of Studio equipment or facilities.

11. Access Fobs

- A refundable $55 deposit applies.
- Fobs remain Studio property, must not be shared, and replacement fees apply if lost or damaged.
- Must be returned upon termination of membership.

12. Liability, Risk Acknowledgement & Waiver
The Studio and MPG aim to provide a safe, professionally supervised rehabilitation and exercise environment supported by qualified Physiotherapists, Exercise Physiologists, and allied health professionals.
While services are designed to support safe participation, exercise, rehabilitation, and physical activity inherently involve some risk of injury, aggravation of pre-existing conditions, illness, falls, or other adverse outcomes.
By participating in services, you acknowledge that you voluntarily participate with an understanding of these risks.
You agree to follow all reasonable instructions provided by practitioners, staff, and contractors and to disclose any relevant injuries, medical conditions, symptoms, or health changes that may affect your participation.
To the maximum extent permitted by law, the Studio and MPG are not liable for injury, loss or damage arising from:
- failure to follow reasonable instructions;
- undisclosed medical conditions or relevant health information; or
- misuse of equipment or facilities,
except where liability cannot be excluded under the Australian Consumer Law or where such loss, injury or damage results from negligence or wilful misconduct.
You agree to release and indemnify the Studio, MPG, and their officers, employees and contractors from claims arising from your participation in services, except to the extent caused by negligence, wilful misconduct or liability that cannot legally be excluded.

13. NDIS Participants
NDIS-funded participants are also bound by our separate NDIS Service Agreement. Where inconsistent, the NDIS Service Agreement and current NDIS Pricing Arrangements and Price Limits prevail.
Participants remain personally responsible for payment where funding is unavailable, exhausted, expired, declined or otherwise not claimable.
NDIS-funded clinical appointments and consultation services may be subject to the NDIS Short Notice Cancellation period (currently two clear business days), in accordance with the participant’s NDIS Service Agreement and current NDIS Pricing Arrangements and Price Limits.
Standard Studio classes, group sessions, and class packs (including NDIS-funded class packs) remain subject to the Studio’s standard four business hour cancellation policy unless otherwise agreed in writing.

14. Debtor Management
Outstanding accounts may be managed in accordance with MPG's debtor management procedures. This may include suspension of access and bookings. You are responsible for all reasonable debt recovery costs.

15. Privacy & Media
By attending the Studio, you acknowledge and consent to CCTV or other recording systems being in operation within the premises for safety, security, operational and incident management purposes.
You also acknowledge that photographs, videos, or other recordings may occasionally be taken and used for promotional, marketing, website, or social media purposes. If you do not wish your image to be used, please notify staff prior to or at the time of attendance.
MPG collects, uses, stores, and discloses personal and health information for the purposes of providing services, treatment, administration, billing, communication, funding claims, and meeting legal and regulatory obligations.
All personal and health information is handled in accordance with applicable privacy legislation, including the Privacy Act 1988 (Cth), and the organisation's Privacy Policy. A copy of our Privacy Policy is available on request.

16. Termination and Refunds
The Studio may suspend or terminate your access where payments are outstanding, terms are breached, or behaviour is unsafe or inappropriate.
- Cooling-off: See Agreement Summary above.
- Permanent illness or incapacity: You may terminate immediately with a medical certificate. You will only be charged for services already provided.
- Other cancellations: After the minimum term, you may cancel with 7 days’ written notice (email accepted). During the minimum term, remaining fees may be required (subject to our discretion for medical or exceptional circumstances).
- Termination takes effect no later than 30 days after we receive written notice. We will provide written confirmation including the final payment and end date.
- Any refund approved by the Studio or required by law will be processed within 7 days.
- We will stop all future direct debit deductions as soon as practicable after valid cancellation and settlement of any outstanding amounts.
- The Studio may terminate or suspend access for outstanding payments, breach of terms, or unsafe/inappropriate behaviour.

17. Changes to Terms & Governing Law
We may update these Terms with notice. Continued use of the Studio constitutes acceptance. These Terms are governed by the laws of Western Australia.
